Hi everyone,
I purchased a foal from a free arabian mare that was supposed to be 6 months pregnant, vet confirmed at the time I made the purchase. I had her stay at the previous owners ranch for 2 months, one month they agreed to and the other month i paid board and then had her delivered to my property when she was supposed to be 8 months pregnant. Upon delivery she did not look in foal so I had my vet check her 6 days after she was delivered to me and sure enough he said she was not in foal and her uterus was small so she had not been pregnant for some time. I contacted them and they asked me what i did to have her absorb her foal so now i am having to take them to small claims. My arguement is that she would have exspelled something that late in the pregnancy and her uterus was small so it had to have happened with them. The only thing i am concerned about is that i signed a boarding agreement in febuary and would her uterus be small if she lost it in february or would it have to be prior? As of now they are counter suiung me for who knows what so i am a littler worried about what is going to happen.. thanks for your help.

Was it YOUR vet who confirmed her in foal the first time? Did you speak with that vet, or did the previous owners just relay the message? Signing a boarding contract should not mean that a sales deception would be void.

ALWAYS HAVE A WELL SPELLED OUT CONTRACT!! I don't know about the size of the uterus at what gestation in a regular sized mare, but I certainly hope it all works out for you.

I got the confirmation from their vet and have a copy but i have also found out that the ranch had a high rate of premature abortions of foals in the past year, this was coming directly from there vet. I have all of the emails for documentation but now they are counter suing me for who knows what and I feel like I am going through a nightmare.
